Carlo VAN ACKER
Carlo Van Acker erwarb 1990 seinen Master of Laws an der Universität Antwerpen ( UA). In seiner Studienzeit war seine Studienwahl hauptsächlich auf Zivilrecht und Strafrecht ausgerichtet. (vertiefte Studien) Nach einer 20-jährigen Karriere in der Antwerpener Anwaltschaft hat er sich in den letzten 11 Jahren auf den gerichtlichen Schutz von Minderjährigen und Erwachsenen spezialisiert. Als professioneller Verwalter hat er zahlreiche Mandate bei den Friedensgerichten im Gerichtsbezirk Antwerpen wahrgenommen. Er berät und vertritt auch die Interessen von Privatpersonen in Fragen und Streitigkeiten in den Bereichen Familienrecht, Miete, Versicherungen und kollektive Schuldenregulierung.
Eva WILLEMS
Eva Willems erwarb im Juni 2022 ihren Master of Laws an der Katholischen Universität Löwen (KUL).
Während ihres Master-studiums spezialisierte sie sich hauptsächlich auf Zivil- und Strafrecht.
Sie schrieb ihre Masterarbeit über Diskriminierung auf dem privaten Mietmarkt.
Im September 2022 legte sie den Eid als Anwältin bei der Antwerpener Anwaltskammer ab und trat dem Team von Studio Legale Advocaten bei. Sie bearbeitet hauptsächlich zivil- und haftungsrechtliche Verfahren.

Lauren RAEYMAKERS
Lauren Raeymakers erwarb im Juni 2022 ihren Master of Laws Cum Laude an der Universität Antwerpen (UA). Während ihres Studiums entwickelte sie ein besonderes Interesse am Straf(prozess)recht und am Arbeitsrecht. Sie schrieb ihre Masterarbeit über die Dekriminalisierung des Schwangerschaftsabbruches.
Im September 2022 legte sie ihren Eid bei der Antwerpener Anwaltskammer ab und trat Sie dem Team von
STUDIO | LEGALE Advocaten bei, wo sie das Team von STUDIO | PENALE Strafrechtsanwälte verstärken wird.

Pauline VANHORENBEKE
Pauline Vanhorenbeke erwarb 2017 an der Université Catholique de Louvain (UCL) mit Auszeichnung ihren Master-Abschluss in Rechtswissenschaften mit zivil- und strafrechtlicher Endgültigkeit. Während ihres Studiums spezialisierte sie sich vor allem auf Versicherungsrecht und Gesundheitsrecht. Sie studierte auch Sozialrecht im Rahmen eines Master nach Master an der Freien Universität Brüssel. Im Juni 2018 legte sie den Eid als Rechtsanwältin bei der Anwaltskammer Antwerpen ab und begann ihr Praktikum bei STUDIO | LEGALE.

Jolien APPELS
Jolien Appels schloss im Juni 2017 ihr Jurastudium an der Universität Antwerpen mit Auszeichnung ab. In den Jahren ihres Masterstudiums konzentrierte sie sich hauptsächlich auf das Zivil- und Strafrecht. Während sie ihre Masterarbeit zum Thema “Die Zukunft der Unwiderruflichkeit der Schenkung” schrieb, vertiefte sie sich in das Familienvermögensrecht. Im Rahmen des Erasmus-Projekts studierte sie ein Semester lang an der Universität von Uppsala in Schweden, wo sie ihre Fähigkeiten im juristischen Englisch weiterentwickeln konnte. Im Oktober 2017 legte sie den Eid als Rechtsanwältin in der Anwaltskammer Mechelen ab. Ein Jahr später trat sie in die Antwerpener Anwaltskammer ein, um dem Team von Studio Legale beizutreten, wo sie hauptsächlich im Zivil- und Unternehmensrecht tätig ist.

Laurie PEER
Laurie Peer erwarb im Juni 2014 ihren Master in Jura an der Universität Antwerpen (UA). Während dieser Studie entwickelte sich ihr Interesse am Zivilrecht und Haftungsrecht. Laurie Peer ist seit September 2014 als Rechtsanwältin in der Anwaltkammer Antwerpen zugelassen und schloss sich bei dem Team von STUDIO | LEGALE an, wo sie weiter spezialisiert auf Haftung, Versicherung, Insolvenzrecht. Darüber hinaus erhielt sie 2017 das Zertifikat von Insolvenzverwalter und befindet sich derzeit in der Postgraduiertenstudium Haftungsrecht und Versicherungsrecht. Sie ist zertifizierte Mediatorin in Zivil- und Handelssachen und hat 2020 eine Ausbildung in sozialen Angelegenheiten bei der renommierten bMediation (BBLC vzx und BCI) absolviert, die sie erfolgreich abgeschlossen hat.

Gert VANOPSTAL
Gert Vanopstal schloss 2010 an der Freien Universität Brüssel sein Jurastudium (cum laude) ab mit einer Spezialisierung im Wirtschaftsrecht. Er besitzt auch die Titel Master in Recht des geistigen Eigentums (2011 - Universiteit Brussel HUB - cum laude) und Master in Gesellschaftsrecht (2015 - Universität Antwerpen - cum laude). Seit 2011 ist er als Rechtsanwalt in Antwerpen tätig und wurde Mitglied des STUDIO | LEGALE Team, wo er sich hauptsächlich auf Handels- und Gesellschaftsrecht spezialisiert hat. In den letzten Jahren hat er zahlreiche Unternehmen beim Erwerb von Aktien, bei der Übertragung von Handelsfonds, bei der Erstellung von allgemeinen Geschäftsbedingungen und bei der Verhandlung verschiedener Verträge (u.a. Aktionärs-, Vertriebs-, Franchise- und Darlehensverträge) usw. unterstützt. Joost PEETERS
Joost Peeters, mitbegründer und Partner von STUDIO | LEGALE, begann sein Jurastudium in Antwerpen (UFSIA) und schloss es über Leuven (KUL) in Rom (ROMA LUISS) ab, wonach er 2001 in die Antwerpener Anwaltskammer eintrat. In der Zwischenzeit spezialisierte er sich auf Versicherungsrecht, Gesellschaftsrecht (auch Übernahmen und Anteilsübertragungen), Gesellschaftsrecht, Miete, Handelspacht, Vertragsrecht, Verkehrsrecht. Joost Peeters ist Verwalter, Insolvenzverwalter und unterstützt Unternehmen in Schwierigkeiten. Er wurde als stellvertretender Friedensrichter in Antwerpen eingeschworen und ist außerdem Rechtsgutachter des Architektenordens. Er ist Inhaber des Zertifikats spezielle Ausbildung in Kassationsverfahren in Strafsachen und hat vor kurzem am renommierten DPI (Data Protection Institute) das Diplom des DSB (Datenschutzbeauftragter) nach der neuen GDPR erworben. Er ist zertifizierter kooperativer Verhandlungsführer und zertifizierter Mediator in Zivil- und Handelssachen. Außerdem absolvierte er im Jahr 2020 einen Lehrgang für Mediation in sozialen Angelegenheiten.

Christian CLEMENT
Christian Clement schloss sein Jurastudium mit Auszeichnung ab an den Universitäten von Antwerpen (UFSIA und UIA). Im Rahmen eines Erasmus-Projekts studierte er sechs Monate lang an der Deutschen Universität Trier. Während seines Praktikums entwickelte sich seine Liebe zum Plädoyer im Allgemeinen und zum Strafrecht im Besonderen. Er absolvierte auch ein Postgraduiertenstudium im Gesellschaftsrecht. Im Jahr 2003 verfolgte Christian Clement seine Praxis - die größtenteils aus Strafsachen besteht - selbständig. Er hat bereits für zahlreiche Fälle vor dem Assisenhof, sowohl für Täter als auch für Opfer, und ihre Familien vertreten. Christian Clement ist Mitbegründer und Partner von STUDIO | LEGALE. Herr Rechtsanwalt Clement ist Mitglied der Kommission Strafjustiz sowie der Gemeinsame Rechtshilfeausschuss der Flämischer Rechtsanwaltsorden. Er ist auch Mitglied der Strafrechtsausschuss des Rates der Anwaltschaften und Rechtsanwaltskammern Europas (CCBE). Olivier BOES
Olivier Boes studierte Jura in Namen und Löwen, und ist seit 1998 als Rechtsanwalt in der Anwaltskammer Antwerpen tätig. In den ersten Jahren seiner Karriere konzentrierte er sich auf alles was mit Versicherungen, Verkehr und Körperverletzung zu tun hatte, aber mit der Zeit begann sein Interesse an Immobilien auch im Recht Vorrang zu haben. Er absolvierte erfolgreich ein Postgraduiertenstudium der Unternehmensund Immobilienrecht, das er mit Auszeichnung abschloss. Jetzt ist er hauptsächlich im Handels- und Zivilrecht tätig, mit einer besonderen Vorliebe für Handelsstreitigkeiten. MEDIATION
Mediation is on the rise. Since the Act of 18 June 2018, the judge can order mediation at any stage of the proceedings on his own initiative or at the request of one of the parties. Courts are increasingly making use of this. The benefit of mediation is the confidential nature of the procedure, which benefits the reconciliation of the parties. The parties themselves work towards an acceptable solution for both parties. This significantly increases the prospect of future compliance with the agreement. We are pleased to assist you in the framework of a mediation proceeding. Studio Legale will assist you as lawyer of one of the parties in the context of a mediation. Currently three lawyers of our office are taking on a course to become a certified mediator.

ADMINISTRATION
It can be advisable to appoint an administrator when someone loses control over his/her actions. Are you already GDPR compliant?
Since 25 May 2018, the General Data Protection Regulation, better known as the „GDPR“, is in force. The GDPR imposes extensive transparency and security obligations. The current management and security of the processed personal data in your organisation must be mapped. Perhaps you will be surprised by the amount of data you have acquired over the years, such as personnel, payroll administration, customers, suppliers, camera surveillance, GPS tracking, use of badges and so on.
Joost PEETERS (lawyer and partner at STUDIO | LEGALE) and Simon GEENS (lawyer at STUDIO | LEGALE), followed an intensive GDPR course and are now, after passing the exam, as from 30 April 2018 and 23 September 2019 respectively holder of the certificate of „Data Protection Officer“ („DPO“), issued by the Data Protection Institute. They guide entrepreneurs to implement the GDPR as efficiently as possible in the company structure.
In order to meet the transparency obligations, records of processing activities, processing agreements, policies and confidentiality agreements have to be drawn up, among other things. You can always count on us for this.
The data must also be protected in practice. In order to optimally integrate the legislation in the company, STUDIO | LEGALE works together with STUDIO | SECURO who will screen the security of the company and display the risks of data leaks in a clear report.

By law of March 23th 2019 consindering the implemention of the new Code of Companies and associations (“WVV”) the “Besloten Vennootschap”, i.e. the “BV” was introduced in Belgian company law. This new company format provides enormous flexibility and offers a range of modalities in terms of management, voting rights and transfer of shares. Founders can fully adapt the articles of association of the BV to the needs of the company and its shareholders. The law provides for a transitory regime consisting of three dates: 01.05.2019, 01.01.2020 and 01.01.2024.
- As from 01.05.2019, new companies have to be founded in accordance with the new company law. Existing companies can also opt-in to the new company law.
- As from 01.01.2020, the mandatory provisions of the WVV will apply for all old company forms. The old companies must fully comply with the WVV at the time of the first amendment of the articles of association.
- By 01.01.2024 at the latest, all old companies must have adapted the articles of association to the WVV.
Although you only have to adapt your articles of association at the first amendment of the articles of association or at the latest on 01.01.2024, it is nevertheless advisable to do so as soon as possible. The provisions of the articles of association that are in conflict with mandatory provisions of the WVV are deemed to be non-written. Furthermore, the new WVV offers the freedom to form your company in the flexible BV entirely according to your needs. Now is the time to review and evaluate your company’s articles of association.
